1) By booking photo session with PHOTO STUDIO KUSMIERCZYK client agrees to all TERMS AND CONDITIONS

2) PAYMENT: Your booking fee will be paid by the client prior to the photo shoot to secure your booking. Remaining balance have to be paid on the session day. Additional images are prepared after the payment has cleared. PHOTO STUDIO KUSMIERCZYK do not hold responsibility for delays caused by late payments. Private online galleries will be closed after 4 days from the date of the access gained by the client. Client is asked to make a choice within that time frame. Once the gallery is closed, PHOTO STUDIO KUSMIERCZYK starts editing images to the final result which may take up to 14 days in total. The gallery of RAW files, unedited images is purely photographer's ownership and hereby not for sale or reproduction. Client pays for the packages in advance and has the right to purchase additional images, not the whole unedited gallery of files.

3) CANCELLATION/SICKNESS: Ir is understood that children/as well as adults can be unpredictable and can fall ill at any time. In the event of sickness prior to the session, Client agrees to make every possible effort to inform PHOTO STUDIO KUSMIERCZYK no later than 48 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 1 month period.

When You book a newborn session with PHOTO STUDIO KUSMIERCZYK, a session slot will be reserved around your baby’s due date. However, should your baby arrive much earlier or past their due date, there will be first available slot offered with no guarantee of a weekend appointment.

No-shows will be treated as a cancellation and in such event session fee paid towards the reservation will be considered lost. In addition, I do not offer session transfers. This means once a newborn/ maternity or any other session has been reserved, the fee paid towards the reservation can not be transferred towards any other photo session.

Session can be rescheduled (given 48 hours notice) only once, after that session fee will be considered lost.

4) Late arrival: In addition, should you come late to your appointment the photographer will allow 15 minutes to wait for your arrival. Time spent awaiting your arrival will be taken of your session's time meaning your session time will be significantly restricted and may result in reduced number of photographs in your final gallery. If you come to your appointment more than 15 minutes late, due to the restricted time frame your session will be unfortunately cancelled and session fee paid towards securing your slot will be considered lost.

5) PRICING & PACKAGES: All Prices stated on the website are inclusive of Pricing & Packages.

6) IMAGES: Quantity of images supplied will vary depending on package chosen and level of activity. Images are edited with a style prefered by photographer and by booking PHOTO STUDIO KUSMIERCZYK client agrees to style and artistic freedom of photographer.

During each of the photo sessions PHOTO STUDIO KUSMIERCZYK always ensure to capture a large number of photographs in various set ups and poses to then create a varied gallery for clients. Certain number of photos will not be included in the final gallery, as they will not be classed as high standard (model's closed eyes, photos out of focus, models looking in the wrong direction etc). This process allows to prepare a decent number of photos to pre select for the clients' final gallery.

8) PERMITTED USES: When client buy EDITED and HIGH RESOLUTION digital images with all printing rights the copyright of all images will belong to PHOTO STUDIO KUSMIERCZYK. You have the right to reproduce any of your digitally purchased images for personal use or to give to family and friends , however, you are not permitted to sell to stock image galleries or to use images for commercial purpose.

9) PRICING: All prices are subject to change at the discretion of PHOTO STUDIO KUSMIERCZYK.

10) You agree to hold harmless, PHOTO STUDIO KUSMIERCZYK and representatives from any dispute in the event you become injured during your session or while on the studio premises. PHOTO STUDIO KUSMIERCZYK and its representatives will not be held liable for any injury incurred by you or your family, or any damage to your property during the photo session or while on studio premises.

The Model shall make themselves available for a photographic event by PHOTO STUDIO KUSMIERCZYK in a private studio in Dudley DY2 8NY; In case of cancellation availability Model will contact PHOTO STUDIO KUSMIERCZYK asap.

11) Photographic Materials. All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, shall be the exclusive property of the PHOTO STUDIO KUSMIERCZYK and will not be held by PHOTO STUDIO KUSMIERCZYK for longer than 3 MONTHS after the session.

When printing your photos please note PHOTO STUDIO KUSMIERCZYK will not be held responsible for poor quality prints from printing shops or online printers. PHOTO STUDIO KUSMIERCZYK can provide you with high quality professional prints, please contact us to discuss further details.

12) VOUCHERS:

In the case of a session booked using a voucher (purchased in advance or received as a gift), failure to attend the scheduled appointment without at least 48 hours’ notice will result in the voucher being marked as used and therefore no longer valid. The voucher is non-refundable and cannot be used to book a new date in such cases.

Clients are allowed to reschedule once, provided that a minimum of 48 hours’ notice is given. Any further attempt to reschedule, or failure to attend the new appointment, will result in forfeiting the voucher.

All vouchers have a specific validity period — either 1, 2, 3, or 6 months, clearly stated at the time of purchase or on the voucher itself. After the expiry date, the voucher becomes invalid and cannot be used or extended.

I hereby acknowledge and agree that the photographs created by the PHOTO STUDIO KUSMIERCZYK shall become and remain the exclusive property of Photographer, and that I retain no rights to said photographs unless specified particularly in this agreement.
